The downtime in recent days is probably due to the update that the same platform made to officially say goodbye to some old devices that are no longer able to support the application. Among iPhones, in fact, phones updated to iOS 10 and iOS 11 versions will no longer be able to use WhatsApp, while for Android you must have at least version 4.1.

It is not the first time that the Meta application has experienced this type of disruption which has caused obvious inconvenience to users, especially those who use WhatsApp for work communications. For some, in fact, a more than spontaneous question arose: are we entitled to a refund?

Since the Covid period, the number of smart workers has increased considerably: comfortably seated at home, but available to their companies. They are certainly the class most damaged by the continuous shutdowns of WhatsApp, but at the same time, it would be impossible to quantify the extent of the damage resulting from the disruption related to the messaging application. An indicator could be WhatsApp Business, although in the guidelines Meta establishes that there are “significant differences” between WhatsApp Business services and fixed, mobile or SMS messaging services and therefore the former may be discontinued in case of need for updates or maintenance. Additionally, Company reserves the right, at its sole discretion, to discontinue providing any or all of the WhatsApp Business Services.

In addition, the contract also specifies that the usability of certain functions could also jump due to events beyond the control of the company itself, such as natural disasters or force majeure events. To give an answer, therefore, at the moment there is no right to a refund, let alone from the moment Meta itself is in crisis.
